Terms of Service

1. Acceptance of Terms

By downloading, installing, creating an account, or using the Zaki application (“App”) and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and CodeStack Lab (“we,” “our,” or “us”), the operator of Zaki.

If you do not agree to these Terms, you must not use the Services. By continuing to use the Services, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into this agreement.

2. Description of Service

Zaki is a smart kitchen assistant and meal planning platform that provides:

Recipe discovery, creation, and management
AI-powered cooking assistant (Chef Zaki) for recipe suggestions and cooking guidance
Meal planning and scheduling
Pantry and ingredient inventory management
Shopping list generation
Recipe scanning from physical cookbooks or handwritten notes
Nutrition tracking
Creator platform for sharing recipes publicly

The Services are available through our mobile application for iOS and Android, and our web platform. Features may vary by platform and subscription tier.

3. Account Registration

To access certain features of the Services, you must create an account. When creating an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your login credentials secure and confidential
Not share your account with any other person
Notify us immediately of any unauthorized access to or use of your account
Accept responsibility for all activities that occur under your account

You may sign up using your email address or through third-party authentication providers (Google, Apple, or Facebook). We reserve the right to refuse registration or suspend accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Free and Paid Tiers

The Services offer a free tier with limited features and a premium tier (“Zaki+”) with enhanced features. The specific features and limitations of each tier are described in the App and may change over time.

4.2 Payment Processing

All subscription payments are processed through the Apple App Store or Google Play Store. By subscribing, you agree to the payment terms of the applicable platform. We do not directly process or store your payment information.

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription through your App Store or Google Play account settings.

4.4 Refunds

Refund requests are handled by Apple or Google according to their refund policies. We do not directly process refunds. Deleting your account or the App does not automatically cancel your subscription or entitle you to a refund.

4.5 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of your next billing cycle. You will be notified of any price changes in advance through the App or via the platform's notification system.

4.6 Free Trials

We may offer free trial periods for Zaki+ subscriptions. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled before the trial expires. Trial eligibility is determined by Apple or Google and is typically limited to one trial per user.

5. User Content

5.1 Ownership

You retain ownership of all recipes, images, text, and other content you create or upload to the Services (“User Content”). We do not claim ownership of your User Content.

5.2 License Grant

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and process your content solely for the purpose of providing the Services. For content you choose to make public (e.g., shared recipes), this license extends to displaying the content to other users of the platform.

5.3 Content Responsibility

You are solely responsible for all User Content you submit and agree not to upload content that:

Is illegal, harmful, threatening, abusive, defamatory, or obscene
Infringes on intellectual property rights of any third party
Contains viruses, malware, or other harmful code
Is misleading, fraudulent, or spam
Violates any applicable law or regulation

5.4 Content Moderation

We reserve the right to review, remove, or restrict access to any User Content that violates these Terms or that we find objectionable, without prior notice. We are not obligated to monitor all User Content but may do so at our discretion.

6. AI-Generated Content

6.1 Nature of AI Content

The AI cooking assistant (Chef Zaki) provides recipe suggestions, cooking guidance, and other content generated using artificial intelligence. AI-generated content is provided for informational and entertainment purposes only.

6.2 No Professional Advice

AI-generated content does not constitute professional dietary, medical, or nutritional advice. Always consult a qualified healthcare provider regarding dietary concerns, food allergies, or nutritional needs. We are not liable for any health consequences resulting from following AI-generated recipes or suggestions.

6.3 Accuracy

While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. We do not guarantee the accuracy, completeness, or safety of AI-generated recipes, ingredient substitutions, or cooking instructions.

7. Account Deletion

You may delete your account at any time through the App's profile settings under Help & Support. When you delete your account:

Your account will be immediately deactivated and all sessions invalidated
Your personal data, recipes, meal plans, and other content will be marked for deletion
Data will be permanently removed from our systems within 90 days
Publicly shared recipes may continue to be visible in anonymized form
Active subscriptions are not automatically cancelled — you must cancel through App Store or Google Play separately

8. Prohibited Uses

You agree not to use the Services to:

Violate any applicable law, regulation, or third-party rights
Attempt to gain unauthorized access to the Services, other accounts, or systems
Reverse engineer, decompile, or disassemble any part of the Services
Use automated tools, bots, or scrapers to access or extract data from the Services
Interfere with or disrupt the integrity or performance of the Services
Upload or transmit malicious code, viruses, or harmful content
Impersonate another person or entity
Send spam, unsolicited messages, or engage in harassment
Resell, redistribute, or commercially exploit the Services without authorization
Circumvent usage limits, subscription restrictions, or access controls

9. Intellectual Property

The Services, including the App, its design, logos, trademarks, graphics, code, and all content other than User Content (collectively, “Our Content”), are owned by us and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works based on Our Content without our prior written consent.

10. Creator Platform

If you participate as a creator on the Zaki platform, you are subject to additional terms:

All recipes you publish must be original or properly attributed
You must not publish content that violates the intellectual property rights of others
We reserve the right to moderate, feature, or remove creator content at our discretion
Creator status may be revoked if you violate these Terms or community guidelines
We may display your public profile, name, and recipes to promote the platform

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. RECIPE SUGGESTIONS, NUTRITIONAL INFORMATION, AND AI-GENERATED CONTENT ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT REPLACE PROFESSIONAL DIETARY OR MEDICAL ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless CodeStack Lab, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of the Services
Your User Content
Your violation of these Terms
Your violation of any rights of a third party

14. Termination

We may suspend or terminate your access to the Services, without prior notice, if:

You violate these Terms or any applicable laws
Your account is involved in fraudulent or abusive activity
We are required to do so by law
We discontinue the Services or any part thereof

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CodeStack Lab is established, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

16. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on this page and updating the “Last updated” date. For material changes, we will provide notice through the App or via email. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Services.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
